SP MLA Irfan Solanki sentenced to 7-year jail term in Kanpur arson case, set to lose Assembly membership

Samajwadi Party leader Irfan Solanki has been lodged in Maharajganj jail for the last one year after being accused of land encroachment by a woman, with more than a dozen cases filed against him.

Uttar Pradesh leader and Samajwadi Party MLA, Irfan Solanki has been sentenced to seven years of imprisonment after he was found guilty in a case of arson in Kanpur's Jajmau area. The judgement was pronounced by the MP-MLA court of Kanpur. The case was registered against Solanki, his brothetr Rizwan Solanki along with three other people and all of them have been sentenced. The Samajwadi Party leade is accused of setting a widpw's house on fire in Jajmau in November 2022. According to the informatin, they have been fined of Rs 2,000 each.

Solanki set to lose Assembly membership 

With this conviction, Solanki is poised to lose his membership in the Uttar Pradesh Assembly. Under the prevailing legal framework, any legislator who receives a prison sentence of two years or more is automatically disqualified from their position in the legislature. This rule ensures that individuals with significant criminal convictions cannot continue to serve as lawmakers. Solanki's recent sentencing triggers this automatic disqualification, thereby vacating his seat in the Assembly and prompting the need for a by-election.

Case registered at Jajmau police station

Earlier on June 1, a hearing was held in the case. The case is registered at Jajmau police station in Kanpur. SP leader Solanki was presented before the court through video conferencing from Maharajganj jail in UP, while Irfan Solanki's younger brother Rizwan Solanki, Israel Aate Wala, Shaukat Ali, and Sharif, all accused in this arson case were physically present in court. The court found all these people guilty on June 3.

What's the case? 

On November 8, 2022, Nazir Fatima lodged an FIR in Jajmau police station against Irfan Solanki, Rizwan Solanki, and three other people under sections 436, 506, 504, 147, 427, 386 and 120B of the IPC, and had alleged that Irfan Solanki and his brother Rizwan Solanki and others, as part of a conspiracy, set her house on fire so that they can take over her land. It should be noted here that Solanki is lodged in the Maharajganj jail of UP and his brother is in Kanpur jail.
