Nirav Modi and Choksi defrauded the Brady House branch of the Punjab National Bank (PNB) in Mumbai to the tune of over Rs 13,000 crore) in alleged connivance with officials.
Chief Judicial Magistrate BH Kapadia declared Modi an absconder in a case filed against him in December 2014 by the Mumbai zonal unit of the DRI.
Mehta said that the Nirav Modi scam was a bygone and hoped that the PNB will be back into the black during 2018-19 due to various efforts taken by the bank after the fraud came to light in January this year.
Two immovable properties having total value of USD 29.99 Million (Rs 216 crores approx) and beneficially owned by Nirav Modi in New York, have also been attached by the directorate under section 5 of Prevention of Money laundering Act.

The former Kingfisher Airlines boss had claimed Wednesday in London that he met Jaitley before leaving India and offered to settle his dues, a charge the finance minister denied and dubbed "false".
Congress alleged that the incumbent government has failed to take action against Nirav Modi and Mehul Choksi despite having information regarding the fraud.
Officials said the request was sent to the Home Ministry on Friday. The Home Minister will send it to Belgium, where Nishal Modi is believed to be holding up, through the External Affairs Ministry.

Suryawanshi said one of the "illegal" bungalows in the district belongs to Mehul Choksi, a diamond trader and co-accused in the PNB scam, but there was a court stay on its demolition, along with some other unauthorised buildings.
In total, there are 121 illegal bungalows in Alibaug and 151 illegal bungalows at Murud in Raigad district, informed the minister.
Nirav Modi and Mehul Choksi are being investigated by the ED and the CBI after it was detected that they allegedly cheated PNB of more than Rs 13,400 crore with the purported involvement of a few of its employees.
The court has asked the duo to appear before it on September 25 at 11 am, the same date on which Nirav has also been summoned by it under the Fugitive Economic Offenders Act.
Last week, an Antiguan media report quoted the Caribbean country's Citizenship by Investment Unit (CIU) as saying that Choksi was granted citizenship there last year after a background check on him got 'no adverse report' from Indian authorities, including police, passport office and SEBI.
Modi and his uncle, Mehul Choksi, are the main accused in the PNB scam and they both left India before the details of the fraud came to light on January 16
Choksi's application for citizenship in Antigua in May 2017 was accompanied with clearance from the local police as required by norm, report in an Antiguan newspaper said.
