Special CBI Judge OP Saini has agreed to hear the plea at 2 pm after the probe agency told the court that custodial interrogation of Karti Chidambaram was required in the matter.
Chidambaram and his son Karti were named in the chargesheet filed by the Central Bureau of Investigation in the case on July 19.
Chidambaram had moved the court on May 30, seeking protection from arrest in the money laundering case.
Swamy, who had earlier moved the top court for expeditious investigation in the Aircel-Maxis case, has sought court's direction for making himself as a party in the fresh plea filed by Kapur against the ED official.
The Delhi High Court had in May granted bail to Karti in the case with a bond of Rs 10 lakh.
In the chargesheet file before Additional Sessions Judge Ruby Alka Gupta, the ED prayed for consideration and subsequent issuance of summons to the accused including Karti.
The probe agency has charged Karti Chidambaram under the Prevention of Money Laundering Act (PMLA) 2002.
Chidambaram, who was considered one of the most powerful ministers in the previous UPA government, was questioned by the probe agency for over six hours.
Chidambaram's role has come under the scanner in the Rs 3,500 crore Aircel-Maxis deal in which the ED has already questioned his son, Karti.
The court has already granted interim protection from arrest till July 10 to Chidambaram's son Karti Chidambaram.

Special Judge OP Saini reserved the order for later in the day after hearing a battery of senior advocates appearing for Karti, son of former union minister P Chidambaram.
However, the court asked Karti to submit his passport and prohibited him from travelling overseas.
The order is likely to be delivered by Justice S P Garg who had reserved his verdict on March 16 after hearing arguments on behalf of Karti and the CBI which had opposed grant of the relief to him.
