KM Asokan, Hadiya’s father, said that he would consider moving a review petition in the Supreme Court against its judgement annulling her marriage with a Muslim man.
A bench comprising Chief Justice Dipak Misra and Justices AM Khanwilkar and DY Chandrachud passed the order on the plea filed by Jahan, challenging a Kerala High Court order annulling his marriage with her.
"Marriage and investigation are two different things. As far as marriage is concerned, it does not warrant any investigation. Investigation has nothing to do with it. You can investigate any other thing," the court said.
The questions from a bench of Chief Justice Dipak Misra and Justices A M Khanwilkar and D Y Chandrachud came during the hearing of the Kerala conversion case.
She also stated that she wants to remain the wife of Shafi Jahan, for whom she had converted to Islam in order to get married.
A three-judge bench of the top court, headed by Chief Justice of India (CJI) Dipak Misra observed that the National Investigation Agency (NIA) cannot go into marital status of Hadiya.
“My demand in the court was freedom, the freedom to meet my husband, but the truth is that I am not free now. I didn’t get freedom.”
