As president, Trump would have the authority to dismiss Smith and halt the federal cases against him. However, he would not have the same control over the New York hush money case or the Georgia prosecution related to his efforts to overturn the 2020 election results in that state.
A bench headed by chief justice NV Ramana said, "We're not against the withdrawal of cases if there is a malicious prosecution. But this needs to be examined by the judicial officer in HC. If the high court agrees then the cases can be withdrawn".
