Delhi HC granted him the relief saying that the Supreme Court last week had given him the liberty to approach the appropriate forum within four weeks to seek further recourse, which he has availed.
The apex court on Friday refused to interfere with the arrest of five right activists and declined to appoint a special investigation team (SIT) to probe their arrest.
The three-judge bench headed by Chief Justice Dipak Misra, in a 2:1 verdict, refused the plea seeking the immediate release of the activists.
The five activists - Varavara Rao, Arun Ferreira, Vernon Gonsalves, Sudha Bharadwaj and Gautam Navlakha - are under arrest at their respective homes since August 29.
The top court told the Maharashtra government that there should be a clear-cut distinction between opposition and dissent on one hand and attempts to create disturbance, law and order problems or overthrow the government on the other.
The bench said it may consider pleas like investigation by a Special Investigation Team (SIT) in the case, if there are some grave lapses.

In a handwritten statement, Bharadwaj said that the letter, which the police claimed was written by her to one “Com Prakash,” was a “mixture of innocuous and publicly available facts and baseless fabrication.”
Some of the 'Maoist leaders' arrested by the Pune Police in a country-wide crackdown earlier this week were part of these groups which acted as 'front face' of the rebels.
The apex court ruled that the five arrested activists- Varavara Rao, Vernon Gonzalves, Arun Ferreira, Sudha Bharadwaj and Gautam Navlakha- will not be sent to jail but be under house arrest until September 6.
A police team from Pune arrested Varavara Rao and had allegedly recvovered a letter mentioning a plan to assassinate Modi from the house of one of the five persons arrested in connection with the Bhima Koregaon violence.
