Asaram is in jail following his conviction on April 25, 2018 in teenager sexual assault case who was a student of his ashram in Rajasthan. His bail has been denied a number of times by the court.
On Monday, a court in Gandhinagar convicted Asaram Bapu, more than nine years after a former disciple of the godman lodged the case.
In several court affidavits, Asaram has said he suffers from multiple ailments, and has been requesting bail on health grounds.
A bench of Justices D Y Chandrachud and M R Shah issued a notice to Sai on Gujarat government's plea challenging the high court's single-judge order and stayed it till further orders.
Senior advocate Siddharth Luthra, appearing for Asaram, said his client has been admitted to the hospital and the court should call for the medical records
Asaram started complaining of having breathing problem on Tuesday night and by Wednesday morning, his condition worsened following which he was shifted to the hospital

The godman was convicted in the case in March 2018 and was sentenced to life in jail.
According to his mercy plea, Asaram has pleaded for dilution in his life sentence terming it to be a "gruelling" punishment and citing his age.

The victim had alleged that Asaram had called her to his ashram in Manai area near Jodhpur and raped her on the night of August 15, 2013.
Gujart CM Vijay Rupani today said it is up to the court to take a decision on fast-tracking the rape case against Asaram and the state government has no role in it.
