The Supreme Court on Friday issued a notice on plea moved by Samajwadi Party leader Azam Khan's son Abdullah Azam whose election from Suar Assembly constituency in Uttar Pradesh was annulled for allegedly being less than the mandatory 25 years of age, when he filed nomination.

 The Uttar Pradesh Police has pasted notices on the house of senior Samajwadi Party (SP) leader and Rampur MP Azam Khan, declaring him, his wife and son as absconders.

The FIR has been filed under sections 420, 467, 468 and 471 of the Indian Penal Code (IPC). The said land was under the possession of Rampur district magistrate.

The matter is related to the dispute in birth documents of Azam Khan's son Abdullah Azam , who is an SP MLA.

The Election Commission had announced that polling for 11 Assembly seats in UP mostly belonging to MLAs who had won the Lok Sabha polls and resigned as members of state assembly will be held on October 21.

Khan will now not be arrested in these 29 cases lodged against him in Rampur by farmers, who alleged that he had usurped their land for the Maulana Jauhar University.

The notices were put up by officials from Ganj police station on the main gate of Khan's residence.

All cases lodged against Rampur MP Azam Khan would be withdrawn if the Samajwadi Party comes to power, its president Akhilesh Yadav said on Saturday, drawing a sharp retort from Union minister Santosh Gangwar, who termed the assertion an "unrestrained gossip".

The notice has been issued to Azam Khan's wife Tazeen Fatima, who is also Rajya Sabha MP and two of their sons - Abdullah Azam Khan and Adeeb Azam Khan under various sections of the Indian Penal Code (IPC) over land encroachment.  

The Uttar Pradesh Police has lodged an FIR against Samajwadi Party leader and Rampur MP Azam Khan's wife Tajeen Fatima for electricity theft in a resort.

Coming out in support of Khan, the SP patriarch said at a press conference here that, "Injustice is being meted out to Khan and SP workers will launch a protest against it".

Superintendent of Police, Rampur, Ajay Pal Sharma said that Nikhat Aflaq is the treasurer of the Jauhar Trust and "we needed to question her regarding the complaints filed by farmers about land grabbing by Azam Khan".

The case has been registered against Khan, former Circle Officer Alay Hasan and four others. The FIR also includes 40 unnamed persons.

The senior leader has been named in the FIR along with former circle officer Alay Hasan, Fashahat Shanu, Virendra Goyal and constable Dharmendra for dacoity, conspiracy and forgery.

As the matter came up for hearing, a bench of justices Pritinkar Diwakar and Justice Raj Beer Singh adjourned the hearing on the petition for August 29 on the request of Khan's counsel R K Jain.

The district administration of Rampur, according to sources, was preparing to demolish the boundary wall of the resort "in a day or two".

The UP police are now preparing to open a 'history sheet' of Samajwadi Party MP Mohd Azam Khan and formally declare him a history-sheeter. Azam Khan has 72 cases against him so far.
