National Herald case: Delhi HC issues notice to Swamy, next hearing on August 5

New Delhi: The Delhi Hight Court today issued notice to Subramanian Swamy in National Herald case and fixed August 5 as the next date for hearing this case.


The High Court, however, refused to stay the order of the Patiala House court in which Sonia, Rahul and other senior Congress leaders were issued summons to be physically present in the court on August 7.

Senior Congress leader and former Union Law minister Kapil Sibal had filed a petition in Delhi High Court challenging the order of Patiala House Court.

Metropolitan Magistrate Gomati Manocha had issued summons to Sonia, Rahul and other Congress leaders in National Herald case  filed by senior BJP leader Subramanian Swamy.

In this case, Swamy has accused  Sonia and Rahul of misappropriating assets worth Rs 2000 crore of National Herald newspaper through a company named ‘Young Indian'.

In an exclusive interview to India TV Digital (www.indiatvnews.com), Subramanian Swamy had explained the charges against Sonia and Rahul in detail.

“The main point of National Herald case  is this. You start from the last step. There was a company set up called “Young Indian Pvt Ltd Company”. They make a big thing that it's a non-profit, section 25 company. So what? Who is the owner of the company. The owner of the company is the mother-son duo who own 76 percent stake. Each of them own 38 percent each. Tomorrow if the company is wound up, the assets of the company will be distributed in that proportion. Second, all the expenses of travel etc are done from company's fund. Forget Rahul Gandhi's idiotic answer that it's a non-profit company. Tomorrow I can't say that I have formed a non-profit company and am going to take over Humayun's tomb which is nearby. How can you take it over?” said Swamy.

“So as I said, let's go with the last step. A company which was set up only with Rs. 5 lakh and no assets whatsoever has come to acquire between 2000-5000 crore worth of property. In fact, their office was at 10, Janpath which is itself illegal. They have properties in Delhi at Bahadur Shah Zafar Marg, in Mumbai where they have built a multi-story luxury apartment, in Bhopal where they have built a mall, in Indore where they have made a huge mall-cum-residential complex and then in Lucknow, Patna and Chandigarh. Now how can a Rs. 5 Lakh company come to own 2000 crore worth of property?” added Swamy.

"Complainant has established a prima facie case against the accused under section 403 (dishonest misappropriation of property, 406 (criminal breach of trust) and 420 (cheating) read with section 120B (criminal conspiracy) of IPC. Hence, let the accused Sonia Gandhi, Rahul Gandhi, Moti Lal Vohra, Oscar Fernandes, Suman Dubey and Sam Pitroda be summoned for August 7, 2014. Let the Young Indian be summoned through it's authorised representative for the same date," Metropolitan Magistrate Gomati Manocha had said while issuing summons to Sonia, Rahul and other Congress leaders.
