Chennai: Former Tamil Nadu chief minister J Jayalalithaa and her close confidante Sasikala have reached an out-of-court settlement with Income Tax authorities and have paid nearly Rs 2 crore for compounding alleged offences, a Metropolitan court was told here today.
The Income Tax department had filed four cases against Jayalalitha and Sasikala for non-filing of IT returns.
In a petition before the Additional Chief Metropolitan Magistrate, Egmore, Chennai, the counsel for Jayalalithaa stated that the Income Tax department had issued an order on November 26, this year, that the Regional Compounding Committee in its meeting held on the same date has decided to accept Jayalalithaa's request for compounding of offences under sec 279(2) of the Income Tax Act, 1961, subject to remittance of the amount stated in the order.
"In view of the order, the petitioner has remitted the amount stated therein and the petitioner's charted accountant submitted challan along with covering letter to the department on November 27 in order to enable the competent authority to pass a final order.
"..Therefore, until the final order is passing in the said compounding application, further proceedings before this court may not be proceed", the counsel pleaded.
"It is further submitted that the personal appearance of the petition before this court for answering the questioning under section 313(1)(a) Cr. P.C. and for framing the charges may not be warranted till the final order in the compounding application is passed by the department", the petition said.
The counsel requested the court to postpone the case by two weeks.
