New Delhi: The Delhi High Court today issued notice to AAP chief Arvind Kejriwal on cancellation of his candidature in Delhi Assembly polls.

The notice has been issued on the plea of Congress leader Kiran Walia which claims that Kejriwal cannot contest from New Delhi as he is a resident of Uttar Pradesh.

Walia alleged that AAP Chief Arvind Kejriwal has been giving wrong residential address because he wished to become an elector from Delhi.

She further said that the matter has been reported to the Election Commission and that Kejriwal's name should be removed from the electoral list and a probe should be ordered into the matter. She added that he has committed a fraud by submitting a false affidavit to the Election Commission that he is a permanent resident of B K Dutt Colony.

According to Walia's allegations Kejriwal had not mentioned the criminal case pending against him in the poll affidavit, hence it should be rejected.

Congress' Kiran Walia also complained to the Commission saying, "How can an ex-chief minister declare the wrong address every time? His name should be removed from the electoral rolls and he should be barred from contesting election."

Ms Walia added, "We said to the Commission that after resigning as the chief minister, Mr Kejriwal shifted from Tilak Lane to Kaushambi (Ghaziabad), but he applied for voter card showing his address as Vittal Bhai Patel House and it was rejected by the Commission stating that it is his office and he cannot show it as residence.

The court has also issued notices to ECI, CEO and five others against inclusion of Kejriwal's name in the list of candidates for the assembly polls.

Elections in Delhi are going to held on 7th Feb where it will elect members of its 70 member assembly.
