Defamation case: Court to hear Phoolka's plea against Congress leader Tytler today

New Delhi: A Delhi court will today hear a criminal defamation complaint filed against Congress leader Jagdish Tytler by a senior lawyer representing the victims in the 1984 anti-Sikh riot cases.

 
The case was listed for this day after additional chief metropolitan magistrate Gaurav Rao had gone for an inspection of Tihar Jail.
 
During the earlier hearing, Tytler had told the court that he was ready to tender an “unconditional apology” to senior advocate HS Phoolka, the complainant in the case, to settle the matter as no public interest was involved in the complaint filed by an individual.
 
Phoolka, however, had refused to accept Tytler's apology. He said that “any compromise” in this situation would send across wrong message to the public.
 
The court then told Phoolka to bring on record the aired interview, in which Tytler had allegedly defamed Phoolka, in the form of VCD/DVD to ascertain facts.

“It has transpired that part of the allegations are oral testimony and part are in the form of transcripts in electronic video cassette... I have to go through the cassette and verify the transcripts,” the additional chief metropolitan magistrate had said.
 
Phoolka filed the defamation complaint against Tytler and alleged that the Congress leader had passed derogatory remarks about him in a news programme aired on September 7, 2004.
