“The Election Commission specifically provides that there shall be no appeal on grounds of caste, creed, community, religion and gender,” BJP's complaint said.
The party has accused Mistry of making statements contravening provisions of the Model Code of Conduct, the Representation of People's Act (RPS) and the Indian Penal Code.
The BJP has demanded to action against Mistry for making statements under Section 505 and making provocative remarks under Section 153 of the Indian Penal Code.
The party has also sought action against him under Section 125(A) of the RPA for promoting enmity between two classes in connection with the election and under Section 123(3) which stands for asking votes by a candidate on the ground of caste, religion, race or class.
Mistry could not be reached for his response.
