The brother of Sohrabuddin Sheikh, who was killed in a fake encounter, has sent notices to three Bharatiya Janata Party leaders demanding an explanation on why he should not file contempt of court petition against them for their remarks on the Central Bureau of Investigation.

In a notice given by his advocate Rajesh Mankad, Rubabuddin has said that the statements made by state BJP president R C Faldu, former president and Member of Parliament Purshottam Rupala and state general secretary and MP Vijay Rupani against CBI amounts to contempt of Supreme Court.

Rubabuddin in the notice has asked the three leaders to give their explanation in seven days, failing which he would file a contempt of court petition against them. The three leaders in a joint press conference organised here on May 2 had hit out at the Congress-led United Progressive Alliance government for "misusing the Central Bureau of Investigation as instrument to tarnish the image of Gujarat government in Sohrabuddin fake encounter case."

The trio had made these remarks after the arrest of IPS officer Abhay Chudasama and summoning of other six senior officers by the CBI, which was handed over the investigation of the case by Supreme Court.

"The leading investigating agency is becoming the Congress Bureau of Injustice (CBI). The Centre wants to disturb the government by demoralising the police force with arrest of senior officials," they had alleged.

The three BJP leaders had said, "at a time when the entire state was busy celebrating golden jubilee of Gujarat, CBI arrested the top cop of Ahmedabad  and summoned other senior officials".

Sohrabuddin was not innocent as he faced criminal cases in four states, they had claimed, adding he was a hardened criminal having links with the underworld.Rubabuddin, in his notice, said the Supreme Court has given the investigation of encounter case and disappearance of Sheikh's wife Kausar Bi following a due legal process in which it had also heard Gujarat government advocates."It appears that the statements made by them were intended to affect the legal inquriy," the notice said.

Shorabuddin Sheikh was killed in an encounter in November 2005, while his wife Kausar Bi was later allegedly murdered. PTI
