Chennai: Madras High Court yesterday dismissed a plea by a firm seeking a direction to the Defence Ministry to allow an higher floor space index for a proposed hotel in a cantonment area here and rapped the petitioner for approaching the court after his earlier prayer was rejected on merits. 





Dismissing the petition by Ceebros Hotels Pvt Limited, represented by Subbha Reddy, Justice K K Sasidharan also noted the petitioner had been using all his contacts to compel the Defence Ministry to increase the FSI.

During pendency of this second petition, he had approached in vain the Defence Secretary with a recommendation from an MP from Andhra Pradesh for allowing higher FSI, the Judge said.

“This is a classical example as to how litigants waste the valuable time of the court with prayer similar to one which has been already rejected on merits and without any change in the circumstances thereafter to convene another round of litigation,” the Judge observed.  T

he petitioner owned 1.40 acres in the Officers Line in Pallavaram here and had submitted an application for planning permission to the Director General of Defence Estate, Ministry of Defence, New Delhi, with a plea for higher FSI.
