Chennai: The Madras High Court today stayed the suspension order passed by Inspector General of Registration suspending a Sub Registrar(Grade I) who was due to retire on August 31, 2014.

Justice R S Ramanathan admitted the petition filed by E V Parthasarathi challenging the suspension order issued on August 26 and the charge memo issued on September 3 and stayed the action until further orders.

The Judge also ordered issue of notice to I G Registration and other authorities on the petition.

The counsel for the petitioner also sought Rs 10,00,000 as compensation for violation of fundamental rights and for having not treated the petitioner fairly and having put the petitioner on mental agony, and hardship.

He said Parthasarathi have completed 31 years of service in the department with “unblemished” service. While he was serving as Anna Nagar Sub-Registrar on May 2, 2011 he has acted as per the direction of his superiors vide their own communications registered a gift deed valued at Rs 4,10,00,000 and collected eight per cent interest as stamp duty and another one per cent as registration fee.

The counsel submitted that even though he brought to the notice of the IG Registration that the property value was at Rs 4,000 per sqft, he was directed by the IG Registration to register the document at the rate of Rs 1,830 per sqft instead of Rs.4000.

Now after five years baseless charges have been leveled against him to make him a “scape goat” and served with the suspension order five days prior to his superannuation with a malafide intention of dragging him forever when there is no fault on his side, the counsel said.

He also prayed for quashing the suspension order and prayed for an interim stay of the all further disciplinary proceedings against the petitionr.
