Gujarat HC refuses Dinu Solanki's petition seeking chargesheet papers

Ahmedabad: The Gujarat High Court yesterday refused to entertain a petition by Junagadh BJP MP Dinu Bogha Solanki seeking chargesheet papers filed by CBI in connection with the case relating to the murder of RTI activist Amit Jethwa.


Justice G R Udhwani refused to entertain Solanki's petition on the ground that the matter is being heard before the Supreme Court.

“The matter is sub-judice before the Supreme Court as is rightly contended by learned counsel for CBI and, therefore, this petition cannot be entertained.

It fails and is rejected summarily,” Justice G R Udhwani said.

In a chargesheet filed before the court of Chief Judicial Magistrate H S Khutwad on December 21, CBI said the BJP MP was involved in Jethwa's murder and named him under Section 120 B (criminal conspiracy) read with Section 302 (murder) of the Indian Penal Code (IPC).

Dinu Solanki had moved a petition before the Gujarat High Court seeking the CBI chargesheet papers.

As CBI filed the chargesheet at the closing time of the court, the magistrate forwarded the chargesheet for verification and kept further hearing on January 4.  

Dinu Solanki's counsel Mitesh Amin had later sought a copy from the court but the magistrate said he needs to verify it before handing over the copy.

Solanki was arrested on November 5 by CBI in Delhi after being unable to give satisfactory answers during his questioning.

He was brought to the city on the next day on a transit remand and he is at present in judicial custody.

The Gujarat police had arrested six persons, including Shiva Solanki, nephew of Dinu Solanki, and sharp shooter Sailesh Pandya who had allegedly shot at Jethwa outside the Gujarat High Court.

All of them were questioned by CBI inside a jail after taking permission from the designated court.
