Ahmedabad: The Gujarat High Court yesterday dismissed a PIL challenging the legality of the Justice M B Shah Commission, set up by the Gujarat government to probe corruption allegations against it.




The division bench of Chief Justice Bhaskar Bhattacharya and Justice J B Pardiwala dismissed the PIL as nobody appeared on the petitioner's behalf.

Mohammed Suleman Rehmatkhan Pathan claimed in the petition that in order to avoid an enquiry by the Lokayukta, the Narendra Modi government set up the enquiry commission under the Commission of Inquiry Act, but it was illegal.

The commission was constituted on August 16, 2011 to probe 17 charges of corruption levelled by Opposition Congress. Among other things, Congress had questioned various land allotments, and alleged that the BJP government was favouring certain industrial houses.

The commission, in its interim report on October 3, 2012, gave a clean chit to the Modi government in nine land allotment cases.
