New Delhi, Sep 30: CBI today opposed in a Delhi court the bail applications of seven accused in 2G spectrum allocation scam on the ground that they could be entertained only after the framing of charges.

The agency, in separate replies, cited the order of the apex court which, while dismissing the bail plea of DMK MP Kanimozhi, had said such applications could be taken up only after the trial judge pronounces order on framing of charges.

Besides Kanimozhi, CEO of DMK-run Kalaignar TV Sharad Kumar, Raja's former private secretary R K Chandolia, Swan Telecom promoter Shahid Usman Balwa, directors of Kusegaon Fruits and Vegetables Asif Balwa and Rajiv Agarwal and director of Cineyug Films Karim Morani have moved their second bail application before the trial court in the case.

Special CBI Judge O P Saini, which took the replies of CBI into the records, would tomorrow hear arguments on behalf of the accused while CBI prosecutor U U Lalit would advance his arguments on October 3.

Opposing the plea of Kanimozhi, the agency said she was the “active brain” behind the operations of Kalaignar TV in which she also held 20 per cent stakes.

Initially, she was also a director of the channel and had a role in “re-appointment” of A Raja as Telecom Minister.

“Kanimozhi was a stakeholder of Kalaignar TV Pvt Ltd to the tune of 20 per cent equity and was an active brain behind its operations. She was also widely covered by Kalaignar Seithigal (News) Channel,” CBI said.

CBI, which opposed the plea of six others, however, said the “court may take an appropriate view as per law” while considering the health condition of Karim Morani. PTI
