Amar Singh Granted Interim Bail For 5 Days On 'Humane' Ground

New Delhi, Sep 15: Hospitalised Rajya Sabha MP Amar Singh was today granted interim bail till September 19 in the 2008 cash-for-vote case by a Delhi court which said he must not be subjected to “undue harshness” and “humane angle” could not be ignored.


While granting interim bail to 55-year-old Singh on health grounds, Special Judge Sangita Dhingra Sehgal also asked the All India Institute of Medical Sciences (AIIMS), where he is undergoing treatment, to submit a detailed report on his day-to-day health status on September 19. 

“The accused (Amar Singh), Member of Parliament (Rajya Sabha) and a known figure cannot be shown extra indulgence but he must also not be subjected to undue harshness as humane angle can never be lost sight of by the courts of equity, justice and good conscience,” the judge said. 

The court also directed AIIMS authorities to apprise the court immediately if Singh is discharged from there. 

“The Director, AIIMS shall submit a comprehensive report based on day-to-day medical health status of accused on September 19 by 11 a.m. In case, the accused is discharged from AIIMS before September 19, Director AIIMS shall apprise the court without loss of time,” the judge said. 

Singh was shifted to AIIMS from Tihar Jail on the evening of September 12 after the team of doctors, who were examining him, recommended that he was required to be shifted to the premier medical institute.

While granting interim bail to Singh on a personal bond of Rs two lakh with one surety of the same amount, the court also asked him to deposit his passport with it and not to leave Delhi without its permission.

While granting interim bail, the court said Singh “shall not tamper with the evidence or try to influence the witnesses. He shall join further investigation as and when required.”

The court also took into account the medical status report submitted by AIIMS before it yesterday saying, “it appears (from AIIMS report) that the health of the accused is fluctuating and perhaps this necessitated his being shifted from Tihar Jail to AIIMS.”

The report had said that there was increase in the creatinine level of Singh and he was suffering from urinary tract infection and his white blood cell (WBC) count has increased which suggested spreading of infection.  Singh was arrested on September 6 after he appeared in court in pursuance to the summons for his alleged role in the scam.

The court would now hear Singh's regular bail plea on September 19. PTI
