What is PASA Act? All you need to know about the Gujarat law that could be implemented in Delhi

The Delhi Lieutenant Governor VK Saxena has approved the proposal of implementing the Gujarat Prevention of Anti-Social Activities Act (1985) in Delhi to take preventive actions against crimes in the national capital. The file has been sent for Home Ministry's approval.

What is PASA Act
Image Source : INDIA TV Delhi L-G has proposed the Centre to implement Gujarat Prevention of Anti-Social Activities (PASA) Act 1985 for implementation in the national capital.

PASA ACT 1985: The Gujarat Prevention of Anti-social Activities (PASA) Act, 1985 (GPAAA) could be implemented in Delhi in order to ensure public safety and law & order. Delhi Lieutenant Governor VK Saxena has proposed to the Centre recommending for the extension of the Gujarat law -- PASA Act, 1985 for the National Capital, which if notified will allow the preventive detention of law offenders.

The prosoal has been sent to Centre by the Delhi L-G and now awaits Ministry of Home Affairs approval for implenetation in Delhi. 

What is PASA ACT, 1985?

Gujarat Prevention of Anti-Social Activities Act, 1985 allows the administation to take bootleggers, dangerous persons, drug offenders, immoral traffic offenders and property grabbers under preventive detention in order to maintain public safety.

The prosal was submitted by Delhi’s Home Department recommending the implementation of the act in Delhi to the Centre on June 27 under Section 2 of the Union Territories (Laws) Act for extending the Gujarat law to the NCT of Delhi.

The Telangana (The Telangana Prevention of Dangerous Activities of Boot leggers, property offenders … etc Act, 1986) was also considered by the Delhi's Hime Department but the Gujarat law was found to be more effective.

In  February this year, Delhi Police vide its letter had requested that the provisions of the Gujarat Act to be examined.

“Section 2 of the Union Territories (Laws) Act, 1950 dealing with Power to extend enactments to certain Union Territories, entails that: “The Central Government may, by notification in the official gazette, extend to the Union Territory of Delhi or any part of such territory, with such restrictions and modifications as it thinks fit, any enactment which is in force in a State at the date of the notification,” an official said.

If approved by the Centre, the act will give more power in the hands of Delhi Police to deal crime incidents like chain snatching, bootlegging, drug peddling and trafficking etc.
