Swati Maliwal assault case: Delhi court sends Bibhav Kumar to 5-day police custody | Updates

Swati Maliwal assault case: Swati Maliwal filed an FIR against Bibhav Kumar for assaulting her at CM's residence on May 13. In the FIR, Maliwal claimed that Kumar hit her with full force again and again and she was kicked and slapped seven to eight times.

Swati Maliwal assault case: Delhi Chief Minister Arvind Kejriwal's aide Bibhav Kumar has been sent to 5-day police custody in connection with the alleged assault case of AAP's Rajya MP Swati Maliwal. Bibhav Kumar was produced before a magisterial court in Delhi on Saturday. The Delhi Police arrested Kumar earlier in the day and his anticipatory bail plea was subsequently observed as becoming "infructuous" by a Delhi court. Kumar was later produced before Metropolitan Magistrate Gaurav Goyal. Police, through their counsel, had sought his seven-day custody to question him in connection with the assault case.

    A Delhi court on Saturday sent Delhi Chief Minister Arvind Kejriwal's aide Bibhav Kumar to five days in police custody in connection with the alleged assault on AAP Rajya Sabha member Swati Maliwal. The Delhi Police arrested Kumar earlier in the day and his anticipatory bail plea was subsequently observed as becoming "infructuous" by a Delhi court. Kumar was later produced before Metropolitan Magistrate Gaurav Goyal who sent him to five- day police custody.

    • The incident happened on May 13 and the FIR was registered on May 16 but no clarification was given for this. No record has been given as to when she (Swati Maliwal) went to the Chief Minister's residence. 
    • She went to the chief minister's residence on her own will, not on anyone's call. There is no mention of when she went to CM's house before May 13, and also what was the purpose of going?
    • It's election time, the CM is busy, has has got interim bail for a limited time. 
    • The time when she went to the Chief Minister's residence was not the official time to meet anyone. She did not go to the Chief Minister's office but went to his residence, and sat on the sofa in the drawing room.
    • Delhi Police responds immediately the 112 calls, but based on what was told to Delhi Police on the call, FIR was not registered immediately. 
    • If someone gets hurt, he immediately seeks medical help from the police and is taken to the hospital, in this case they didn't wait for police.
    • It's not possible that there is no response to the call of 112 in Civil Lines area and it goes blank because the Chief Minister's residence and LG's office are there.
    • If someone who was beaten so much that she could have died does not take any medical treatment, how can this happen?
    • The CCTV camera of CM office is under the control of Delhi Police.
    • Delhi Police lawyer raised objection and saying CCTV camera is under PWD.
    • She met the SHO but if there was a deep injury on her body then why did the SHO not seek any medical sheet.

    • Bibhav Kumar's phone has to be opened. Apps are password-protected. He hasn’t disclosed those passwords. We need his presence to open the phone.
    • He formatted the phone in Mumbai. We have to take him to Mumbai.
    • He has already been terminated. He has no official order to work for the chief minister. CM office is a sensitive area. We have to see if he has a connection with anti-social elements.

    Arvind Kejriwal in a video address, amid the row over Rajya Sabha MP Swati Maliwal's alleged assault case, on Saturday alleged that the BJP government wants to put all the AAP leaders in jail.

    Lashing out at the Centre, Kejriwal said, "The PM is playing game of 'jail and jail'. I, along with all my top leaders, including MLAs and MPs, will come to the BJP headquarters at 12 pm tomorrow. You can put all of us in jail. Do you think you would be able to crush the AAP after sending everyone to jail? That's not possible as the AAP is an idea."

    However, the Delhi Chief Minister did not speak about Swami Maliwals' alleged assault case.

Kumar was picked up from the chief minister's residence by a Delhi Police team around noon, a senior police officer said. He has been taken to the police station for interrogation.     AAP MP Swati Maliwal, who was allegedly assaulted by Delhi CM Arvind Kejriwal's personal aide Bibhav Kumar, has bruises over her left leg dorsal and right cheek, according to her medical report. This comes as Maliwal filed an FIR against Kumar for assaulting her at CM's residence on Monday. In the FIR, Maliwal claimed that Kumar hit her with "full force again and again" and she was "kicked and slapped seven to eight times". Maliwal's medical examination was conducted on Friday. According to her medico-legal certificate (MLC) from AIIMS, Maliwal has "bruises over proximal left leg dorsal aspect of approx size 3x2 cm and right cheek elbow below right eye of approx size 2x2 cm".
