In a recent development in the case involving the assault of AAP MP Swati Maliwal, the Delhi Police has incorporated a fresh section under the Indian Penal Code against Bibhav Kumar, an aide of Chief Minister Arvind Kejriwal. Kumar stands accused of assaulting Maliwal at the official residence of the Chief Minister on May 13, sparking a heated legal battle.
New section added
The Delhi Police has added Section 201 of the IPC, about "disappearing evidence and giving false information," in the ongoing investigation.
Legal ramifications
Section 201 carries the provision of imprisonment for a period equivalent to one-sixth of the punishment awarded for the primary offence.
Previous charges
Earlier, an FIR was registered against Kumar on May 16, citing various IPC provisions, including criminal intimidation, assault on a woman with the intent to disrobe and attempt to commit culpable homicide.
Evidence tampering allegations
During the investigation, Kumar's mobile phone was found to have been formatted. He was taken into custody on May 18 from Kejriwal's residence.
Forensic examination
The police have sent three CCTV DVRs collected from Kejriwal's residence to the forensic science laboratory to ascertain if tampering has occurred. However, the reports are still awaited.
Ongoing legal proceedings
Kumar, arrested on May 18, is detained in Tihar jail. The investigation continues as authorities seek to uncover further details surrounding the incident.
