In a major relief for celebrities like fashion designer Rocky S, cricketer Bishen Singh Bedi's son Angad Bedi, Supratik Roy, actor Amit Gaur and others, the police told the court that all those who had only consumed drugs would face bailable offences.
A mere consumption of drugs is a bailable offence, as against selling.
The special Narcotic Drugs and Psychotropic Substances Act court here was hearing anticipatory bail applications of 13 out of the 44 persons who had tested positive for drugs following the police raid at hotel Oakwood in suburban Juhu in May.
Police today said that all those who were partying and had taken drugs would be booked only for consumption.
However, Disc Jockeys Deepesh Sharma and Rakesh Sharma, and the organizer Suryaprakash Ijangare, were facing conspiracy charges.
After noting the police's reply, the court disposed of the anticipatory bail pleas of those who are accused of only consumption.
The order on the anticipatory bail pleas of Sharmas and Ijangare is reserved till Saturday.
As many as 44 out of the 92 people rounded up during the high-profile rave party at the hotel in Juhu last month were tested positive for drugs.
Police received samples for 46 of the 92 people who attended the sundown party. 44 of the 46 males tested positive for the drugs, said Police Commissioner Arup Patnaik.
The results of the other 46 people, including two IPL cricketers, Wayne Parnell and Rahul Sharma (both played for Pune Warriors India), and 38 women, have not been received yet, he added.
According to police, these 46 men were taken to the civic-run Cooper hospital after they were rounded up along with 46 others partying at Oakwood Premier Hotel on May 20. The rest were taken to JJ Hospital and Bhabha Hospital.
The hospitals took urine and blood samples for alcohol presence testing and the same samples were also sent to Kalina Forensic Laboratory for drug tests.
Among the 44 who tested positive so far, 27 had consumed cannabis, one had MDMA (better known as ecstasy, a drug usually taken in pill form) while 16 had consumed MDMA as well as cannabis, according to Patnaik.
29 among these 46 persons had alcohol during the party and the invitations were sent through internet.
On the invitation, it was mentioned ‘support the music and not the drugs'.
Of the 4,000 (music) tracks seized from the DJs at the party, 95 per cent of the tracks were of trance music.
A day after the raid, police had also arrested Vishay Handa, the director of the hotel, under the NDPS Act.Fashion designer Rocky S and Angad Bedi, son of cricketer Bishen Singh Bedi, had sought anticipatory bail in this case.
Similarly, Supratik Roy and actor Amit Gaur had moved for an anticipatory bail and the court has given them protection from arrest.
