Anand Parkash to reopen abetment to suicide case against Rathore
Winning a legal battle after 19 torturing years would have normally meant peace of mind for someone relentlessly fighting for a cause. But for the complainant couple in Ruchika molestation case, Anand Parkash and wife Madhu Parkash, the fight for abetment of Ruchika'a suicide will go on.
The conviction by court yesterday, for them, may mark an end to the molestation case, but not the case of the abetment of her suicide, which they will take up again. In fact, the special judicial magistrate, CBI Ambala, had ordered to include the charge of abetting Ruchika's suicide into the chargesheet under section 306 of the IPC against former Haryana DGP SPS Rathore.
He, however, filed a plea before the HC, asking for the order of the special judicial magistrate to be quashed.
Subsequently, the charge of abetting Ruchika's suicide against Rathore was quashed by the Punjab and Haryana High Court on February 12, 2002.
"The Ambala CBI Court had added the offence of abetment to suicide but it was later quashed by the High Court after Rathore moved an application. The statements of Ruchika's brother Ashu were recorded after that. Based on his statements we plan to open the case of abetment of her suicide," said Anand.
Ashu had deposed before the Ambala CBI Court in 2004 that Ruchika was forced to take the extreme step as she went in depression following the molestation incident.
"Now that the quantum of sentence to Rathore has been questioned in the Rajya Sabha by the CPI (M) MP Brinda Karat, I am hopeful that justice will prevail," Anand said, adding that they would move a fresh application in the case soon.
"Much more happened after the molestation incident, I lost my friend after that. I am upset with the quantum of sentence announced, though relieved that justice finally prevailed. But our fight for the case of suicide abetment will go on," said Aradhana, friend of deceased Ruchika and daughter of Anand Parkash
