New Delhi: The Supreme Court on Monday refused to intervene in the ongoing tussle between Narendra Modi-led Central government and Arvind Kejriwal-led Delhi government.
The top court, however, agreed that the constant fight between the two governments has hampered the development in the capital.
The alleged tug-of-war between the Centre and the AAP government reached the Supreme Court which said it was up to them to sit across the table and resolve all disputes.
Refusing to entertain a PIL alleging that governance deficit has led to recent deaths from dengue, a bench of justices T S Thakur and V Gopala Gowda said it was for the two governments to sit together and resolve the disputes and give good governance.
"This is a matter of governance and governance deficit, you cannot challenge. Your concern, we understand that there is the central government on the one hand and the government of Delhi on the other. ... These problems can be sorted at the ends. If any order is bad then we can look into it," the bench said.
"On one side you have the Narendra Modi government at the Centre and the other led by Arvind Kejriwal. If they do not resolve their disputes and continue to create governance problems then people will pass an appropriate verdict at the appropriate time,” the court said the told petitioner Tapesh Bagati who wanted the SC to order the Kejriwal government to abide by the Constitution.
It said that it can come entertain a plea when a specific case is pointed out.
"Is this some kind of 'amrit dhara' petition. These are not matters in which we come in. If you bring a specific case, we can examine who is faulting...," it said.
Bagati's counsel had told the court the lack of governance had crippled the functioning of Delhi. Civic bodies had failed to function properly hygiene had been neglected, leading to dengue deaths and spread of the disease.
