New Delhi, Nov 3: Congress today came out with a guarded response to the rejection of the bail plea of DMK MP Kanimozhi in 2G case, saying “bail and not jail” should be the guiding principle.

“We will first have to study the judgement and then, if required, we will articulate any opinion. However, the flow of jurisprudence has been that bail and not jail should be the guiding principle,” Congress spokesman Manish Tewari said. 

While refusing to go into the merits of the judgement, Tewari also reminded that there have been cases where superior courts have come to conclusions which were entirely different from the findings of the subordinate court. 

“But as to why a particular court has arrived at a particular conclusion can only be discerned after perusal of the judgement. Having said that it is not unknown in our legal scheme of things that a superior court can come to a conclusion which may be totally different from the findings of a subordinate court,” he said.

Sources close to M Karunanidhi in Chennai said that the DMK chief is ‘very upset' over rejection of bail to his daughter.
