The only eyewitness in the Apple Executive Murder case, Sana Khan, on Tuesday refuted the findings of the post-mortem report, which claimed that the bullet was fired from a top angle.
Sharing the horrific details of what happened during the night Police Constable Prashant Chaudhary shot and killed Lucknow-resident Vivek Tiwari from a close range, Sana said that the constable was standing on the road and not on top of the bonnet as indicated in the post-mortem report.
Sana rebutted the self-defence theory claimed by the UP Police as, she said, there was no damage or threat to the two cops and their two-wheeler. Speaking to India TV reporter in Lucknow on Tuesday, Sana claimed that two policemen had tried to stop Tiwari's car but when he did not heed to their command, they angrily tried to overtake the car.
"The car was never moving at a fast pace. When they tred to stop us by standing on the rod, Tiwari sir just slowed down a bit and attempted to skirt around Prashant Chaudhary who was standing right in front of the moving vehicle," she said, adding that the police constable was shouting in anger as if something very serious had already happened.
She further revealed that the constable shot Tiwari from front of the car, and not from top, while the other accused stood next to her car door. "Car never stopped during this process...even after Sir was hit he tried to take the vehicle away. We moved ahead for 10-15 seconds before hitting a wall," the eyewitness said.

The lone eyetwiness' testimony also disputes the condition of the vehicle involved. The victim's car parked in the police station is severly damaged, whereas the victim claimed that the collision of the vehicle was mild as the car was at a slow speed. "The vehicle hit in such a manner that I sustained some injuries but nothing life-threatening. Air bags had opened but the car no way nearly as damaged as it is now," Sana said.
Vivek Tiwari, who worked with Apple as area sales manager, was shot from close range by a constable late on Friday night after he failed to stop his SUV during checking in Lucknow's posh Gomti Nagar neighbourhood.
The UP Police has suspended the two constables involved and has initiated an SIT probe. The victim's family has since met UP Chief Minister Yogi Adityanath as well as opposition leader and SP chief Akhilesh Yadav, who assured them speedy justice.
