Sushant Death Case:Updates: SC to hear Rhea Chakraborty’s plea on Wednesday

The Supreme Court is scheduled to hear on August 5 a plea filed by actress Rhea Chakraborty who has sought transfer of an FIR, lodged against her in connection with the death of actor Sushant Singh Rajput, from Patna to Mumbai.

As per the cause list uploaded on the apex court's website, the transfer petition filed by Chakraborty will come up for hearing before a bench of Justice Hrishikesh Roy on Wednesday.

 Veteran Bollywood actor Anupam Kher has opened up on the death of Sushant Singh Rajput. Kher feels, after so many ups and downs, and conspiracy theories, the case should reach a logical conclusion because his family and fans deserve to know the truth. "Sushant's family and fans deserve to know the truth. So much has been said, there are so many conspiracy theories, but it is not about who stands on which side anymore, it is about ensuring, that this case reaches a logical conclusion. We must know the truth. #JusticeforSushant," tweeted Anupam Kher on Tuesday.

Governor of Bihar accords his consent to Central Bureau of Investigation (CBI) to investigate/supervise and inquire into the case registered in Patna.

After Chief Minister Nitish Kumar said the Bihar government has decided to recommend a CBI inquiry in actor Sushant Singh Rajput's death case, Bihar DGP Gupteshwar Pandey, in a tweet said, "Hopefully Sushant will get justice now."

Bihar chief minister Nitish Kumar on Tuesday set up a fresh row over its probe into Sushant Singh Rajput, recommending a CBI probe into the actor’s death. “The state government has sent its recommendation for a CBI probe into the FIR registered by Sushant Singh Rajput’s father KK Singh,” Nitish Kumar tweeted on Tuesday afternoon after completing the paperwork to make the recommendation.

The lawyer of Sushant Singh Rajput's father told ANI, "I don't think any state govt would have quarantined an enforcement officer. Quarantining of a police officer clearly means they want to disable or obstruct the investigation by Patna police. Basically, Mumbai Police is buying time to ensure that the evidence gets destroyed. So we decided that this matter should be given to CBI and Nitish Kumar had earlier promised that if the father wants a CBI probe, it will be handed it over to CBI."

Post Nitish Kumar's statement, Rhea Chakraborty's lawyer was quick to react. He told ANI, "There can't be transfer of a case which had no legal basis for Bihar to get involved. At most, it would be a 'Zero FIR' transferable to Mumbai Police. Transfer of a case,on which they had no jurisdiction, to CBI has no legal sanctity: Satish Maneshinde, #RheaChakraborty's lawyer."

The Petition Filed by Rhea Chakraborty in SC that Bihar Police had NO jurisdiction to Investigate the case will continue in SC. There cannot be transfer of a case which had no legal basis for Bihar to get involved . At the most it would be a  "Zero FIR" and transferable to Mumbai Police. The transfer of a case on which they had no jurisdiction to CBI has no legal sanctity. Having realised that Bihar has no jurisdiction this illegal method has been adopted. Otherwise you are interfering in the Federal Structure of our Nation in a back door manner . Hearing in PIL filed in Bombay High Court, seeking transfer of Sushant Singh Rajput's death case to the Central Bureau of Investigation, postponed due to heavy rains in Mumbai.

Bihar DGP Gupteshwar Pandey, in an interview with IndiaTV, said that the family's trust might have broken looking at the condition of Bihar Police in Mumbai which is why they took this step. They must have understood that Bihar police want to help them but they are unable to do things because of a lack of co-operation. "Sushant's father has not spoken to me for now, once he will speak to me we will forward their plead to the government, says DGP. He also said that will not send any officer to Mumbai now because it is of no use now.

Speaking to IANS, Pandey alleged that Mumbai Police was "not cooperating" with Bihar Police in the probe into the alleged suicide case of Bollywood actor and was "speaking the language of actress Rhea Chakraborty" who has been blamed by the bereaved family for the death of Rajput.

Bihar CM Nitish Kumar told IndiaTV, "I have spoken to his father and family and they have given the consent. The CBI inquiry was suggested by everyone in the case. As soon as Sushant's father filed an FIR in the case, Bihar police started their investigation but they did not get co-operation from the Mumbai police. Bihar IPS Vinay Tiwari was also quarantined despite proving prior information of his arrival. Today only we have got the consent the family and so CBI inquiry will take place. If CBI will take things in their hands, there will be a proper investigation. The treatment by the Mumbai police was not right. Not only Bihar, but the country also has the same demand. The recommendation will go to the CBI today itself and the detailed information will be given to you by DGP.

Soon after the late actor's father KK Singh spoke to Nitish Kumar and requested him to order CBI investigation, Bihar CM recommended CBI investigation into the actor's death case. Previously, the CM said that the government can initiate a CBI probe on the condition if the family demands it.

Bihar DGP G Pandey says, "They've forcibly quarantined an IPS officer. If Maharashtra govt is proud of their police, then tell us what they've done in 50 days after death of Sushant S Rajput. Mumbai has closed all communication channels with us. This indicates that something is wrong."

The move to quarantine Bihar officials probing Sushant Singh Rajput death case is wrong. This shows that there is something suspicious. NIA, Enforcement Directorate must probe the matter. It's high time now, Centre should intervene: BJP MP Nishikant Dubey.

Lok Janshakti Party leader Chirag Paswan has written to Bihar CM Nitish Kumar requesting him to order CBI inquiry in Sushant Singh Rajput death case. Paswan also requests him to speak with PM & Maharashtra CM on "misconduct" with Bihar Police officer in Mumbai to probe the case.

Rhea Chakraborty has always been living in Mumbai. She was in Mumbai on 14th June 2020. She was not allowed to attend the Funeral of Sushant Singh as her name was stuck off from the list of 20. She was summoned by Mumbai Police on 18th of June 2020 at Bandra Police Station . Her statement was recorded there. Subsequently she was summoned to appear on 17th July 2020 at Santacruz Police station .  She appeared and recorded her supplementary statement. 

Later on when the Bihar Police came to Mumbai to investigate a case on the basis of an FIR registered at Patna , she approached the Supreme Court and filed a Transfer Petition on 30th July 2020 for Transfer of the Case to Mumbai in view of the Legal Position that A case registered beyond the jurisdiction of the local police station where the alleged incident has taken place can only record a “ Zero FIR “ and transfer it for investigation to Mumbai where the criminal law has already been set in motion. The Bihar Police has no jurisdiction to investigate the case legally and otherwise.

The ongoing war of words between Mumbai Police and Bihar Police took a turn for the worse on Monday after Bihar Director General of Police (DGP) Gupteshwar Pandey questioned the Mumbai Police as to why they did not investigate the money trail while probing the suicide of Bollywood actor Sushant Singh Rajput.

Amid the logjam between Bihar Police and Mumbai Police over probing the Sushant Singh Rajput death case, The Maharashtra government said the Bihar Police does not have the right to investigate. According to the legal opinion given by the legal experts to the Maharashtra government, the case is not under the jurisdiction of the Bihar Police. 

Sushant Singh Rajput's former domestic help Akhilesh spoke to India TV and said that everyone has some trouble or the other in their lives and Sushant also went through some difficult times, but there was no hint of depression. He used to give food and medicines to Sushant and revealed that Rhea used to order him for work but he only listened to the actor since he was the one who hired him.

A bench of Bombay High Court (HC) will hear public interest litigation (PIL) seeking transfer of Sushant Singh Rajput's death case to the Central Bureau of Investigation (CBI) today. The matter will be heard by the bench headed by Bombay HC Chief Justice Dipankar Datta. The PIL for transferring the case related to the actor's death to the CBI has been filed by one Sameet Thakkar, through his lawyer Raspal Singh Renu.

Param Bir Singh, Commissioner of Police, said, "Rhea was one of the 56 people questioned by Mumbai police. Her statement was recorded twice & she was called to the police station several times. I can't comment about her whereabouts. Sushant's father, sister and brother in law's statement were recorded on June 16. At that moment, they didn't raise any suspicion neither they complained about any lapse in our investigation. 

Till now statements of 56 people have been recorded, all angles are being investigated be it a professional rivalry, financial transactions or health. It has come to the surface that Sushant had bipolar disorder, he was undergoing treatment and taking medicines for it. What circumstances led to his death is the subject of our investigation.
