Swati Maliwal assault case: FIR registered against Arvind Kejriwal's PA Bibhav Kumar

The Delhi Police registered an FIR in Swati Maliwal's assault case hours after it visited AAP's Rajya Sabha MP's residence to take her statements. The FIR was registered under Indian Penal Code sections pertaining to the offence of violence against women, they said.

Swati Maliwal assault case: The Delhi Police on Thursday registered an FIR in the assault case of Swati Maliwal, Aam Aadmi Party leader and Rajya Sabha MP, hours after senior cops visited her residence today to take her statements in the case. According to the Delhi Police, the FIR mentions the name of Delhi Chief Minister Arvind Kejriwal's Personal Assistance (PA) Bibhav Kumar.

According to sources, in her 7-page complaint to the Delhi Police, Swati Maliwal alleged that she was assaulted by Arvind Kejriwal's PA at Delhi CM's residence on Monday.

Swati Maliwal was slapped several times on face, kicked below abdomen, say sources  

Sources have said the FIR mentioned that Swati Maliwal was slapped by Kejriwal's PA Bibhav Kumar on the face for 5-6 times. It also mentions that she was kicked below the abdomen during the assault. The entire incident took place in the drawing room of Delhi CM Kejriwal's residence.

Arvind Kejriwal was present at home when all this happened, reports said.

  • Bibhav hit her in the chest, on the face, stomach, the lower part of the body
  • Swati Maliwal said she was on her periods and was in a lot of pain
  • She came out and called the Delhi Police

The Delhi Police has registered FIR under sections 354, 506, 509 and assault section 323.

IPC Section 354 stands for assault or criminal force on a woman with intent to outrage her modesty, 506 stands for punishment for criminal intimidation and 509 for word gesture or act of intent to insult.

IPC 354 is a non-bailable offence, which means that the accused cannot be released on bail without the permission of the court. The punishment for this offence can range from imprisonment for a term of up to two years to imprisonment for a term of up to seven years and also include a fine.

According to reports, the Delhi Police will also verify the role of Chief Minister Arvind Kejriwal in this entire matter. Several teams have been formulated to arrest Bibhav Kumar.

The FIR was registered after Maliwal's statement was recorded by a two-member team, led by Additional Commissioner of Police P S Kushwaha. It was at the Rajya Sabha member's residence in Central Delhi for nearly four and a half hours.

The development comes two days after Maliwal went to the Civil Lines police station and alleged that a member of Chief Minister and Aam Aadmi Party (AAP) national convener Kejriwal's personal staff "assaulted" her at the CM's official residence.
